 BANKRUPTCY
Chapter 7
bankruptcy allows the debtor to obtain a complete discharge from all dischargeable debts. This is the most complete form of a bankruptcy, offering a fresh start. When a debt is discharged, the debtor no longer has an obligation to pay creditors. In a Chapter 7 bankruptcy, the debtor's property is liquidated to pay creditors. However, in most cases all of the property of the debtor will be either exempt or have insufficient resale value to motivate the bankruptcy trustee to sell the property. Chapter 13 bankruptcy allows the debtor to reorganize existing debt while putting a complete stop to foreclosures, repossessions, wage garnishments and tax liens. In a Chapter 13, any past due payments owed to secured creditors such as those holding liens on homes and cars are consolidated along with debts owed to unsecured creditors, i.e. credit cards, and the debtor makes one monthly payment to the trustee to pay these debts, while maintaining the regular monthly payments to secured creditors. Depending on the debtor's financial situation, debtors may only be required to pay a percentage of their unsecured debts.

In most instances and depending upon the circumstances, both chapters allow the debtor to keep their home and/or cars. In addition, upon the filing of either chapter, collection actions, garnishments, creditor harassment, etc. must cease.

The worker receives these benefits until he or she is able to return to work or is released from the doctor's care.

Penalties may include suspension or loss of license, jail or prison time, probation, substantial fines, increased insurance premiums and a permanent criminal record.
